BACKGROUND:


Robert Blazer is owner of “Your Dekalb Farmers Market” in Decatur, GA. Mr. Blazer started the market in 1977 to provide the best source of fresh food direct from the farmers. Prior to starting the business, he had several years’ experience in discount store retailing and in buying and selling produce. Mr. Blazer is also owner of World Direct Shipping (WDS), which has had a weekly service call to Port Manatee since 2014. WDS’s produce is grown, packed and shipped from farms in Mexico, Central and South America direct to wholesale receivers all over the USA.


Mr. Blazer is author of Our World Market “The Generational Distinction” Our Connection to Life which is available on Amazon and iTunes. Written in 1989 after his father was diagnosed with lung cancer, it reflects what all of us have in common and is based on working with people from all over the world and his dealings with a very diverse customer base.


Mr. Blazer has a Mechanical Engineering degree from the University of Rhode Island that he utilizes for the design and construction of the facilities he has built. He is married to Barbara and has a son; both are involved in the business.

BACKGROUND:


Matt McPhail is Vice President, Sales and Marketing, for Federal Marine Terminals (FMT). He has been with FMT since 2005 beginning in customer service. Prior to his current role of Vice President, Matt was the Sales and Marketing Manager. He oversees all commercial activities for FMT’s 12 operations located throughout the Great Lakes, US East and Gulf Coast. Matt is supported by a staff of three in the sales and marketing group along with all general managers having commercial responsibilities.


Matt has a Bachelor of Arts in Political Science with a concentration in Corporate Communication from College of Charleston.

    DESIGNATION OF RIGHTS

    BACKGROUND:


    The litigation in Port Manatee Land, LLC v. Manatee Port Authority and Manatee County, Case No. 2002-CA-5873, was abated pending the resolution of an access issue for property located adjacent to Port Manatee that is currently owned by Port Manatee Land, LLC (PML).


    To facilitate settlement of the litigation, on April 22, 2008, Manatee County joined in the execution of a public access easement through South Dock Street.


    In 2017, the Authority desired to make improvements to South Dock Street and PML agreed that such improvements would satisfy certain bypass road requirement of the settlement agreement so long as the easement was amended to ensure an appropriate turning radius on South Dock Street and Reeder Road.


    The Authority has now made such improvements and therefore the Easement was amended to add the additional easement area, which totals 1.85 acres. On March 20, 2018, the Board of County Commissioners approved the Amended and Restated Grant of Easement.

    which: (1) widens the easement area an additional 50 feet to the north, (2) extends the easement west into Reeder Road, and (3) limits the use of the previously granted easement areas so as not to interfere with the storm water conveyance ditch and piping, as depicted on the Description Sketch attached to the Amended and Restated Grant of Easement as Exhibit

    1. The Authority must now approve the amended Easement.


In addition, the Assignment and Designation of Rights must be approved which permits PML to cross the railroad crossing located on South Dock Street.

WHEREAS, the Deed of Easement permits the Port to assign any of its interest in the Deed of Easement to the Port’s “successors, assigns, employees, invitees and agents;” and

WHEREAS, PML is the current owner of real property adjacent to the Port and such real property takes access along South Dock Street over the railroad crossing, which was the subject of the Deed of Easement; and

WHEREAS, the Port seeks to designate PML and its invitees as “assigns or invitees” under the Deed of Easement to more formally allow such parties to cross the railroad crossing.

NOW THEREFORE, in consideration of the promises and mutual covenants contained herein and in consideration of $10.00 and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged by the Parties, the Parties agree as follows:

On October 19, 2017, the Authority accepted into the record Agreement Number EMW- 2017-PU-00462-S01 from FEMA for the North Gate Expansion and Improvement Project. Total project costs are $1,262,600 which will be funded 75% by FEMA with 25% match requirement made by the Port. Under the Port Manatee continuing contracts dated October 16, 2014, Stantec Consulting Services Inc. has submitted a proposal of $204,100 for the design, permitting and construction phase services for the kiosk/canopy building and associated site improvements. In addition, Universal Engineering Sciences has submitted a proposal of $7,600 for geotechnical services, construction materials testing and structural steel inspection.
